Appraisal Institute Forum Terms of Use
Welcome to the Appraisal Institute Forum (AI Forum). The Appraisal Institute values a diversity of viewpoints and expects users of AI Forum exhibit the same level of respect for others as they would in any other professional or academic forum. To help maintain the AI Forum as a professional and useful resource for appraisers the Appraisal Institute asks that each user of the AI Forum (Forum User or you) read and adhere to the terms of use (Terms of Use) set out below.
1. Acceptance of Terms of Use
These Terms of Use (Terms of Use) shall govern your access, content, and participation in AI Forum. The Appraisal Institute reserves the right to modify, suspend, or terminate AI Forum and / or these Terms of Use from time to time at its sole discretion and without notice.
By continuing to use the AI Forum, you indicate that you have read and agree to these Terms of Use in their entirety.
2. Disclaimer
The information presented on AI Forum has been prepared for informational purposes only. AI Forum is provided on an AS IS and AS AVAILABLE basis. While the Appraisal Institute seeks to present accurate, reliable, complete, current, and useful information on AI Forum, it does not guarantee the accuracy, completeness, efficacy, or timeliness of such information, and therefore, makes no representation or warranty regarding the same.
The Appraisal Institute does not recommend or endorse any specific products, opinions, or other information that may be mentioned on AI Forum. The information contained on AI Forum does not constitute legal, accounting, appraisal or other professional advice. If you have specific questions related to your situation, you are encouraged to consult an appropriate professional who can review the particular circumstances of your situation.
3. User Content
Any content and/or opinions submitted to AI Forum are solely the opinions and responsibility of the Forum User (User Content) submitting them and do not necessarily reflect the opinions of the Appraisal Institute. The Appraisal Institute bears no responsibility for any User Content or any injury or offense it causes. The Appraisal Institute has no obligation to pre-screen, monitor, edit, or delete User Content, however, the Appraisal Institute reserves the right to do so, and to not-publish, edit or delete any User Content at its sole discretion, including but not limited to situations where the Appraisal Institute believes that any User Content fails to comply with these Terms of Use or is otherwise harmful, inaccurate, or objectionable.
By uploading or otherwise transmitting User Content to AI Forum, you represent and warrant that: (1) you are the owner or licensee of such User Content and have a right to post it; (2) the User Content does not and will not violate the intellectual property rights of any person; and (3) the posting of user Content does not and will not violate these Terms of Use. You grant the Appraisal Institute the non-exclusive, worldwide, royalty-free, unrestricted license (with the right to sub-license) to reproduce, distribute, publicly display and perform, transmit, adapt, translate, modify, and create derivative works of any User Content in whole or in part and in any form now known or later developed.
4. Links to Third Party Sites
AI Forum may contain links to other web sites (Linked Site). You acknowledge and agree that these Linked Sites are not under the control of the Appraisal Institute, and the Appraisal Institute does not endorse and is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Your use of any Linked Site is at your own risk and subject to the terms and conditions of use for such Linked Site.
5. User Conduct
The Appraisal Institute values a diversity of viewpoints and expects Forum Users to exhibit the same level of respect for others as they would in any other professional or academic forum.
Accordingly, use of AI Forum and your User Content must be consistent with the following:
You must remain polite, civil, professional and courteous at all times.
You may not use AI Forum to defame, disparage, stalk, harass, or otherwise threaten to violate the legal rights of any person or entity.
You may not post material containing comments which are inappropriate, profane, offensive, obscene, indecent, pornographic, or otherwise unlawful.
You may not post material containing portrayals on the basis of race, religion, political affiliation, ethnic group, gender, sexual preference, disability, or other protected class.
You may not violate an individual’s privacy by posting comments or materials about any aspect of an individual’s personal life.
You may not upload or post materials which you do not own (for example, photos, images, software, writings, articles or substantial portions of books).
You may not discuss litigation or threatened litigation involving the Appraisal Institute.
You may not upload files that contain viruses, trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operations of another’s computer or property.
You may not post material or propose activities that mislead or defraud others or that may reasonably be considered as deceptive or fraudulent.
You may not engage in disruptive activity in AI Forum, such as persistent off-topic contributions or comments, or statements that might incite other Forum Users to violate these Terms of Use or participate in illegal activities.
You may not post confidential or proprietary information as this is a public forum.
You may not misrepresent the source of anything you contribute.
You may not use AI Forum for commercial purposes, including but not limited to the posting of: services, job postings, referrals, pyramid schemes, chain letters or other solicitations.
You may not use AI Forum to discuss or exchange information about prices, fees, or terms of service or engage in any other communications that may be deemed a violation of anti-trust laws. Messages that may restrain trade or encourage or facilitate an agreement about the following subject areas are not permitted: process, discounts, or terms or conditions of sale; salaries; profits, profit margins, or cost data; market shares, sales territories, or markets; allocation of customers or territories; or selection, rejection, or termination of customers or suppliers.
You may not harvest or otherwise collect information about others, including e-mail addresses.
You may not engage in activities that would violate any fiduciary relationship, any applicable local, state, national or international law, or any regulations having the force of law.
You may not create a false identity for the purpose of misleading others.
You should not post any User Content, statement or material to AI Forum that may embarrass you or the Appraisal Institute if read in open court.
You may not use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of AI Forum or other user or usage information or any portion thereof.
You may not use AI Forum to engage in any activity that is unlawful or in violation of the Appraisal Institutes Bylaws, Regulations or other applicable Appraisal Institute Policies.
6. Removal of User Content / Termination of Use
The Appraisal Institute reserves the right, but does not assume any responsibility, to (1) remove from AI Forum any material / User Content posted by you which the Appraisal Institute, in its sole discretion, deems inconsistent with these Terms of Use; and/or (2) terminate your access to all or part of AI Forum. However, the Appraisal Institute can neither review all material / User Content prior to transmission on AI Forum nor ensure prompt action with respect to objectionable material / User Content after it is transmitted on AI Forum. Accordingly, the Appraisal Institute assumes no liability for any action or inaction regarding transmissions, communications, or other User Content that is provided by third parties. The Appraisal Institute reserves the right to take any action it deems necessary to protect the personal safety of users of AI Forum and the public, however, the Appraisal Institute has no liability or responsibility to anyone for performance or nonperformance of the activities in this paragraph.
The Appraisal Institute reserves the right in its sole discretion to suspend or terminate your access to AI Forum or to restrict access to AI Forum at any time (i) if it suspects that you have not complied with these Terms of Use, or (ii) for other reasons that the Appraisal Institute determines in good faith are necessary or appropriate, including if the Appraisal Institute suspects you are using or attempting to use AI Forum in any way that violates applicable laws or regulations. The Appraisal Institute is not liable to you for any loss or damage that may result from its refusal to provide you access to AI Forum.
7. Confidential Information
All User Content submitted to AI Forum is submitted at your own risk. The Appraisal Institute cannot guarantee the security or confidentiality of any User Content, you should consider all User Content you submit to be non-confidential and assume that any ideas, inventions, or know-how disclosed in it could be made available to the public.
8. Release of Information
The Appraisal Institute reserves the right at all times to disclose any information, including but not limited to User Content, uploaded to or appearing on AI Forum to the extent necessary to comply with any applicable law, regulation, legal process, subpoena, or governmental request. Therefore, remember that any written comments, statements, User Content posted to AI Forum may be subject to disclosure.
9. Privacy
You agree to indemnify and hold the Appraisal Institute harmless from any and all claims arising out of or relating to the publication or display of your name and/or contact information. The Appraisal Institute does not warrant or represent that the information you submit to AI Forum will be protected against loss, misuse, or alteration by third parties.
10. Digital Millennium Copyright Act ("DMCA") Notice
The Appraisal Institute respects the intellectual property rights of others and requests the users of AI Forum to do the same. Pursuant to Title 17, United States Code, Section 512(c)(2), notification of claims of copyright infringement relating to material / User Content on AI Forum should be sent to the following Designated Agent:

11. Indemnification
You agree to indemnify and hold harmless the Appraisal Institute, its officers, directors, employees, agents, affiliates, third-party information providers, licensors, and others involved in the delivery of AI Forum or the delivery of services or information over the AI Forum, from and against any and all claims, actions, liabilities, expenses, damages, and costs, including reasonable attorneys fees, arising from your use of AI Forum and/or any information obtained from AI Forum and/or any violation by you of this Terms of Use and/or any violation of any Appraisal Institute Policy and/or any violation of any local, state, federal or applicable international law or regulations.
12. Limitation on Liability
The Appraisal Institute will not be liable to you or any third-party for any claims or actions including any direct, indirect, incidental, special, consequential or punitive damages, arising or resulting from your use, visit, or participation in AI Forum and for any modification, suspension, or termination of AI Forum, or termination of your access to AI Forum, including, but not limited to, lost profits or damages resulting from delay, interruption in service, viruses, deletion of files or electronic communications, or errors, omissions, or other inaccuracies in AI Forum or the content transmitted on AI Forum or personal injury, whether or not there is negligence by the Appraisal Institute and whether or not the Appraisal Institute has been advised of the possibility of any such damages.
13. Governing Law
This Terms of Use and your use of AI Forum shall be governed and constructed in accordance with the laws of the State of Illinois, U.S.A., without giving effect to any principles of conflicts of laws. You consent to the exclusive jurisdiction and venue of courts in the State of Illinois, U.S.A. in all disputes arising out of or relating to the use of AI Forum.
14. Severability
This Terms of Use and all other Appraisal Institute Policies, including but not limited to those referenced in this Terms of Use, constitute the entire agreement between the Appraisal Institute and you with respect to AI Forum and it supersedes all prior contemporaneous communications and proposals, whether electronic, oral or written, between the Appraisal Institute and you with respect to AI Forum.
15. Waiver
The Appraisal Institutes failure to insist upon or enforce strict performance of any provision of this Terms of Use shall not constitute a waiver of the provision.

Any suspected violations of these Terms of Use should be immediately reported to aiforumadmin@email.appraisalinstitute.org. Additionally, the Appraisal Institute welcomes your comments, and any feedback regarding AI Forum, please direct these comments to aiforumadmin@email.appraisalinstitute.org.
